1. Introductory Provisions
These Terms of Use (hereinafter: Terms) govern the use of the Nutritutors web application (hereinafter: Application), which is available at https://nutritutors.si and operated by Nutritutors d.o.o., Kopivnik 63, 2313 Fram, Slovenia, registration number: 9703128000 (hereinafter: Operator).
By using the Application, the user confirms that they are familiar with these Terms, understand them, and fully accept them.

The Operator reserves the right to immediately and without prior notice disable access to the Application if there is a justified suspicion that the user is intentionally or unintentionally attempting to harm the Application (e.g., server attacks), regardless of whether the user is aware of such activities or whether they are performed by the user or a third party using their equipment. The restriction lasts until the violation is resolved.

The Application may offer users access to advisory services provided by verified experts (e.g., dietitians). Before connecting with an expert, the user must explicitly confirm that they consent to the transfer of their personal data, which may include health-related information, to the selected expert.
The Operator is not responsible for any decisions made by the user based on such advisory services, except in the case of proven professional misconduct by an authorized expert. Experts providing services through the Application are not necessarily considered part of the official healthcare system under Slovenian law, unless explicitly stated otherwise.
7. Intellectual Property Rights
All content displayed in the Application, including texts, graphics, logos, icons, and source code, is the intellectual property of the Operator or its contractual partners and is protected by copyright and other intellectual property rights.
The user may not copy, distribute, or otherwise use this content without the express written permission of the Operator.
8. Personal Data Protection
The Operator collects and processes users' personal data in accordance with applicable law and the Privacy Policy. By using the Application, the user confirms that they are familiar with the Privacy Policy.
The Operator may also process sensitive user data (e.g., body weight, height, dietary habits, health information, etc.) solely based on the user's explicit consent in accordance with Article 9(2)(a) of the General Data Protection Regulation (GDPR). Users must actively confirm their consent before using parts of the Application that involve such data.
The user also agrees that their data is stored and processed in Amazon Web Services (AWS) data centers in Ireland, which is located within the EU and ensures an adequate level of data protection.
The Operator has carried out a Data Protection Impact Assessment (DPIA) related to the use of the Application, processing of health data, and transfer to cloud infrastructure, and has implemented appropriate organizational and technical security measures.
9. Limitation of Liability
The Operator is not liable for any damages arising from the use or inability to use the Application, including data loss, income loss, or loss of business opportunities.
The Operator does not guarantee the accuracy, completeness, or timeliness of the information in the Application.
The Operator is not liable for any negative consequences arising from the user's reliance on nutritional or other recommendations obtained through the Application, especially if the user has not fully and accurately provided their health or dietary details.
10. Changes to the Terms
The Operator reserves the right to change these Terms at any time. Changes become effective upon publication on the website. The user is considered aware of the changes if they continue to use the Application after the changes have been published.
11. Dispute Resolution and Applicable Law
These Terms and any disputes arising from the use of the Application are governed by the laws of the Republic of Slovenia. In the event of a dispute, the competent court is the court in Maribor.

If the user uploads documents for verification purposes (e.g., as a dietitian), such documents are retained for a maximum of 30 days or until successful verification – whichever comes first. After this period, the documents are permanently and securely deleted. By uploading the documents, the user explicitly consents to their processing for the stated purpose.
